ALFAREROS, MONTERREY, NUEVO LEÓN, POSTAL CODE 64753, TELEPHONE (81)1522 2896, EMAIL [email protected] AND HEREINAFTER FOR ALL PURPOSES HEREINAFTER REFERRED TO AS "OMICRONLAB", WHO ISSUES THIS PRIVACY NOTICE COMMITTED TO THE SECURITY AND PROTECTION OF PERSONAL DATA, IS RESPONSIBLE FOR THE USE AND CONFIDENTIAL TREATMENT OF THE SAME, FOR SUCH REASON IT WILL SEEK AT ALL TIMES THAT THE CONTROLLED USE IS CARRIED OUT, IN ORDER TO GUARANTEE THE PRIVACY OF THE USER, BY MEANS OF A CONTINUOUS EXAMINATION OF THE PROCESSES OF SAFEGUARDING DATA, BOTH PHYSICALLY AND DIGITALLY.

OBJECT OF THE PERSONAL DATA:

The personal data collected from the user, will be used essentially for: -the product and/or service you requested, -will be used as an informative resource about changes or updates to the products and services provided by OMICRONLAB, -answer questions or comments, -protect the Property, Rights and personnel of the responsible, among others.

Personal data and sensitive personal data obtained by OMICRONLAB, may be reviewed, processed and transferred, within our company, as well as with Third Party Collaborators. To carry out the purposes described in this privacy notice, we will use the following personal data:

PURPOSE OF COLLECTING AND USING PERSONAL DATA

The personal data provided by the user will be treated as described below:

Identify you within the digital platform.

- Clinical analysis.

- Identification of the physician in front of patients.

- Profiling and verification.

- Quote services or products.

- Communicate changes and/or updates to the Services and/or Products.

- Review of medical prescriptions.

- Requests of any nature related to OmicronLab.

- Development of new products and services

commercial.

- Medical research.

- Advertising and commercial prospecting purposes.

Additionally, your personal data may be used for purposes that are not necessary for the provision of the service, however, they will allow us to provide you with a better service, to inform you of new services within the platform and to evaluate the quality of the service provided by you.

 

We inform you that your personal data is shared inside and outside the country with the following persons, companies, organizations or authorities other than us, for the following purposes:

 

  • Holding companies, affiliates and/or subsidiaries: for the purpose of Centralized Information safekeeping, control of registrations, cancellations and/or modifications, Activity Report and Customer Registration.
  • Authorities, governmental agencies or entities: for compliance with the obligations set forth in the applicable legislation and/or compliance with the requirements of the same authority.
  • Collection: for the collection management of accounts receivable in court or out of court.

We inform you that personal data and sensitive personal data may be transferred to health authorities, in compliance with the applicable legislation.

 

You are hereby informed that genetic data and hormonal data may be used by OMICRONLAB for the following purposes: i) development of new products, ii) implementation of new commercial services, iii) scientific publication, iv) teaching, v) similar purposes, among others. Notwithstanding the foregoing, OMICRONLAB undertakes to safeguard the patient's identity at all times.

 

Your personal data will at no time be made available to third parties that may undermine the proper handling of the same. Your sensitive personal data will at no time be used for discriminatory purposes.

 

Your personal data will be used and stored in accordance with the Mexican Official Standard "NOM-004-SSA3-2012".

 

TRANSFERS

OMICRONLAB in order to comply with the necessary purposes described above or any other legally required by the competent authorities, may transfer personal data necessary for the following purposes:

The transmission of personal data that require your express consent, at all times will be done anonymously, so OMICRONLAB will omit sharing your name and identification data.

 

OMICRONLAB, will use and transmit your personal data for the time that is necessary, appropriate and relevant for the fulfillment of its purposes. In the case of sensitive personal data, reasonable efforts will be made to limit the period of transmission thereof, however you may revoke the authorization granted herein, at the time you so desire.

OMICRONLAB, is a legal entity in full exercise of its rights and with all the capabilities and legal powers necessary to market products and services, therefore, the scope of this instrument, which is aimed at accessing and obtaining personal data, may be carried out through information provided by you directly, e-commerce, mobile application, website, telephone and/or camera phones and mobile computers, as well as through other sources that are permitted by law.

 

OMICRONLAB, undertakes to keep the confidentiality of personal data obtained in the processing of information, in accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties.

 

OMICRONLAB, is responsible only and exclusively for the personal data strictly registered on its platform, and therefore disclaims any additional information provided by the user.

 

ARCO RIGHTS

Article 16 of the Political Constitution of the United Mexican States recognizes as a Human Right the protection of personal data of any user, as well as the option to express their opposition in the terms established by Law to control the information they share with third parties, as well as to ensure that it has a correct use.

 

As the owner of personal data, you have the right to Access, Rectify, Cancel and Oppose your personal information held by third parties, this power is called "ARCO Rights".

- Access: The right to know the personal information that is being processed, as well as the scope of the processing.

- Rectification: The Right to correct your personal data, if it is incorrect, inaccurate or outdated.

- Cancellation: The right to request at any time, the deletion of personal data that you consider are not being used in accordance with the Law.

- Opposition: The right to request cessation of the processing of your personal data in the face of a specific situation that could harm your person, such as could be advertising purposes.

 

MEANS OF EXERCISING RIGHTS OF ACCESS, RECTIFICATION, CANCELLATION OR OPPOSITION

OMICRONLAB, has all the structure, technology and resources necessary to ensure that all your personal and sensitive data will be treated with strict adherence to the Federal Law on Protection of Personal Data Held by Private Parties.

 

Therefore, at all times, you will have the right to request the exercise of the Rights of Access, Rectification, Cancellation and Opposition (ARCO Rights), with respect to your personal data. Likewise, it is your right to limit the way in which your personal data will be used and revoke the consent previously granted, provided that such information is not necessary for the purposes described in the preceding paragraphs, or is the result of

a legal relationship.

REVOCATION OF CONSENT TO YOUR PERSONAL DATA

You can revoke or withdraw all of your personal data (total revocation) or only some of them (partial revocation), according to your own interests, however, all personal data that you submit, have as a purpose within the obligations contracted with OMICRONLAB, therefore, if you cancel, or oppose the data that prevent, affect or restrict the fulfillment of your relationship contracted with OMICRONLAB, it will be considered as terminated, since your personal data can no longer be used for any purpose.

 

Therefore, you are requested that when submitting your request for revocation of consent, please indicate whether it is in respect to the processing of your data, either in whole or in part.

 

The revocation of your consent will not proceed in cases where your personal information is necessary to comply with a legal obligation.

The exercise of the Rights will be free of charge, upon proof of your identity, with the exception that you must cover the justified shipping costs or the cost of reproduction in copies or other formats.
